#Unsilencing Balochistan: Zur Lage der Menschenrechte in Pakistan

Nachrichten aus Pakistan sind rar geworden. Doch die Drohnenkampagne der USA läuft genauso wie die Operationen der pakistanischen Armee. Dabei sind die Probleme äußerst vielschichtig und reichen von Kämpfen in Waziristan über Gewalt im urbanen Umfeld Karatschis hin zu Unruhen in Belutschistan. Dort läuft gerade eine Social-Media-Kampagne unter dem Hashtag #UnsilencingBalochistan:






Sie bezieht sich auf die Absage einer Universitätsveranstaltung, auf der die Probleme der Region diskutiert werden sollten. In einem Schreiben der Universität hieß es dazu:
Such cancellation is a gross violation of freedom of expression, freedom of assembly, freedom of information, academic freedom and political pluralism.

We, as students, staff and faculty at LUMS, are most concerned about this cancellation, and the gross lack of democratic freedom and political pluralism that it manifests. It is all the more unacceptable that Balochistan has witnessed important human rights violations for the past decades, notably enforced disappearance of citizens. Persecution of religious minorities has also become commonplace in Balochistan, which has led to migration by non-Muslims and minority Muslim sects in large numbers to other regions of the country as well as abroad. The targeting of Shia Hazaras of Balochistan is one of the most violent and persistent persecution of any community.

The Human Rights Commission of Pakistan notes that in spite of the large amount of financial and natural resources of the province, no serious and sustained attempt to delivery the benefits of that to the people of Balochistan has been made.
Die "ganze Aufregung" um eine solche Absage macht deutlich, wie schwierig die Menschenrechtslage in Pakistan seit langer Zeit ist. Die schlechte Sicherheitslage wird immer wieder als Argument gebraucht, wenn es um Einschränkungen der Meinungs- und Versammlungsfreiheit geht.

Im Jahresbericht von Human Rights Watch wird das Dilemma von schlechter Sicherheitslage und Einschränkungen von Grundrechtne deutlich:
The government is failing at the most basic duty of government – to protect the safety of its citizens and enforce rule of law. [...] The government failed to amend or repeal the blasphemy law provisions that provide a pretext for violence against religious minorities. [...] Journalists who cover counterterrorism issues or write critically of the military faced increasing threats.
Auch die Situation von Frauen zeigt die extreme Rechtsunsicherheit und das Klima, das durch alltägliche Gewalt und staatliche Willkür geschürt wird. In einem Bericht vom April 2015 heißt es:
Eight years into its democratic transition, violence against women is still endemic in Pakistan, amid a climate of impunity and state inaction. Discriminatory legislation and a dysfunctional criminal justice system have put women at grave risk. [...] The extent to which rights violations go unpunished is particularly alarming in FATA and KPK, where women are subjected to state-sanctioned discrimination, militant violence, religious extremism and sexual violence. Militants target women’s rights activists, political leaders and development workers without consequences.
Dabei spielt das Parlament eine marginale Rolle bei der Gestaltung der Politik des Landes:
Because of repeated direct or indirect authoritarian interventions during Pakistan’s history, its parliaments have either been absent, short-lived or rubber stamps for the military’s policies, their proceedings hollowed out and meaningless. Even under civilian rule, an overactive judiciary has repeatedly encroached on parliamentary prerogatives, while the executive branch has dominated the governance agenda; legislative advice and consent has been more a matter of form than substance.
Die Justiz wird dabei als Gegengewicht zur Exekutive betrachtet, doch auch hier gibt es große Probleme, vor allem im Bereich der Militärgerichtsbarkeit:
If Pakistan’s military courts are going to operate in secret and prohibit any meaningful public scrutiny and verification of their observance of fair trial rights, no tweets can cover up the fact that the government’s pursuit of high-speed “justice” for alleged terrorists is coming at an unacceptable price.
In Balochistan geht es speziell um mehr Autonomie für die Region und die Auseinandersetzung hat teilweise die Form eines Sezessionskonflikts. Doch auch hier wirkt sich die Schwäche der pakistanischen Institutionen und der schlechten Menschenrechtslage aus und befeuert diesen Konflikt. Dann reicht auch eine Absage einer Podiumsdiskussion, um Proteste in der ganzen Region auszulösen.
